Terms of Service

Welcome to Movrly. By downloading, accessing, or using the Movrly mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account or using the App, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are between 13 and 18 years of age, you confirm that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

2. Health Disclaimer

IMPORTANT: Movrly is a fitness tool and is not a substitute for professional medical advice, diagnosis, or treatment. Always consult your physician or qualified health provider before starting any new exercise program, especially if you have pre-existing health conditions, injuries, or concerns.

The AI-generated workout plans and coaching provided by the App are based on the information you provide and general fitness principles. They are not tailored medical advice. You assume full responsibility for your use of the App and any exercises you perform. If you experience pain, dizziness, or discomfort during any workout, stop immediately and seek medical attention.

3. Account Registration

You must create an account to use the App. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary.

4. Subscription Terms

Movrly offers subscription-based access to premium features. By purchasing a subscription:

• Billing is processed through the Apple App Store or Google Play Store ("Platform"), subject to the Platform's terms and conditions
• Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date
• You can manage or cancel your subscription through your Platform account settings
• Refunds are handled by the Platform in accordance with their refund policies
• We reserve the right to change subscription pricing with reasonable notice; price changes will take effect at the start of your next billing period

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of these Terms
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's infrastructure or other users' access
• Create multiple accounts or use another person's account
• Use automated tools to scrape, collect, or extract data from the App
• Submit false, misleading, or harmful content through the App

6. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, exercise descriptions, AI-generated workout plans, and software — are owned by Movrly or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7. User Content

You retain ownership of any content you submit through the App, including workout logs and coach messages. By submitting content, you grant Movrly a non-exclusive, worldwide, royalty-free license to use, process, and store that content solely for the purpose of providing and improving the App's services.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Movrly and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to:

• Personal injury or health issues resulting from following AI-generated workout plans
• Loss of data or unauthorized access to your account
• Service interruptions or errors in AI-generated content

Our total liability for any claims arising under these Terms shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

10. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may terminate your account at any time by deleting it through the App settings. Upon termination, your right to use the App ceases immediately. Sections relating to intellectual property, limitation of liability, disclaimers, and governing law survive termination.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in San Francisco County, California.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App and updating the effective date. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
